This is because some insurance companies will make very unreasonable settlement offers and play hardball because they want to see what a personal injury lawyer will do. With the computers and verdict reporting software that’s out there, it’s really easy for an insurance company or a trucking company to do a verdict search on a lawyer and a law firm, to find out about that lawyer’s reputation, and his willingness to take cases to trial. So they can find out pretty quickly if it’s been 15 years since that lawyer has tried a case. From that, the insurance companies know whether to play hardball, or whether they should settle faster and for more money. And if a lawyer doesn’t take cases to trial, or have a reputation for being willing to take cases to trial, that insurance company knows that it can always settle that case cheap.
So if you’re a client out there, and you’re researching a potential lawyer to represent you, the most important thing for you to know is really, a firm’s trial reputation. The insurance industry knows it. It’s really the key to getting a better settlement and a faster settlement. If the insurance company and the people on the other side already have that information, I guess the question is, “Shouldn’t you also?”"
