i was injured at work and recently laid off due to cut backs. my question is …if im expecting a settlement for the injury will it effect my unemployment benefits ? i live in illinois.

A WC settlement would not stop unemployment benefits, they are calculated on what you paid in not what you have or may have.}{

When they file for divorce after the separation will the spouse be entitled to any part of the settlement?

It depends on the wording of the settlement and if the other party is mentioned in the settlement, for example, if part of it is for "pain and suffering" or "loss of companionship" for the other partner, then he/she would be entitled to that part, but in general, no, the settlement is typically the sole property of the injured party.

Sounds like it’s just the "lottery winnings" you were waiting for…go ahead and make the jump, IF you can live with it afterwards……….

I had a fall at work. Tore my calf muscle and had shoulder surgery. Went through the therapy and just recently was released from the Dr,

Your medical bills will be paid, as will your lost time. Other than that I’m not sure why you should be paid anything? Most falls are the fault of the employee. It’s reasonable that their medical and lost time be paid, but no more.

I was a passenger of a car accident that was at fault of the driver. I suffered a broken femur and both shoulders were fractured along with numerous cuts and stitches from glass fragments. I spent 4 days in the hospital due to the leg fracture, had a titanium rod put in as well. I had to drop out of school and i am unable to work for approx 8 months. I would like to know how much money i can expect to receive in suing the drivers insurance company for anything possible.

First of all, you aren’t suing the insurance company. You’re simply making a claim for medical bills. In most states, a passenger in a car is afforded the same benefits as the driver, and therefore you will not be entitled to anything over your medical costs. And they will only cover your medical bills if the driver had medical coverage, which is usually optional. If that is the case, you will need to sue the driver of the car, not his insurance. Call the claims adjuster who is handling the case and find out if you are, or are not entitled to compensation for pain and suffering. You also might want to consider making a claim on your own insurance, if you have it.
